Terms
These terms apply to every use of instnt studio, offered by instnt. Studio is meant for businesses: by starting an account you confirm you act for your company.
Trial
A trial lasts 14 days and needs no payment details. Afterwards you choose a plan. Without a plan you can still log in and look, but Studio no longer fetches data or checks your sites. After 90 days without a subscription we delete the projects and the data Studio fetched for them; we email you 30, 7 and 1 day beforehand. Your account and invoices remain.
Plans and billing
Prices on the pricing page exclude VAT. Monthly plans are invoiced afterwards, counted per day. Yearly plans are invoiced upfront with 20% off.
A larger plan starts right away: on a monthly plan you pay per day, on a yearly plan you pay the difference for the rest of the year. A smaller plan starts after the period you have already paid for. Whatever no longer fits the smaller plan is set aside, not deleted, and can be restored on a larger plan.
Payment
Invoices are sent by email and are due within 14 days, through the payment link or by bank transfer. Businesses in another EU country with a VAT number that VIES confirms are invoiced with VAT reverse-charged.
Late payment
If an invoice is still unpaid 14 days after the due date and after a reminder, we may suspend the workspace: you can still log in and look until the invoice is paid. Statutory interest and collection costs may apply.
Price changes
We announce price changes at least 30 days in advance by email. They apply from your next billing period; for a yearly plan from the next year. You can cancel before the change takes effect.
Term and cancellation
A monthly plan runs per month and ends at the end of the month in which you cancel. A yearly plan renews by a year and ends at the end of the current year if you cancel before then. You cancel in the app (Settings → Subscription and invoices) or by email, and you can withdraw a cancellation until it takes effect. There is no notice period beyond the current paid period.
Pausing
If you pay monthly, you can pause your subscription for 1 to 3 months once every twelve months. During a pause you pay nothing and can log in and look, but Studio fetches nothing, does not monitor your sites and sends no alerts or reports. Nothing is deleted during a pause. Afterwards the subscription resumes by itself; you can resume earlier at any time.
Extra room
On top of your plan you can buy extra room, such as extra projects or AI tasks. We bill it monthly in arrears and per day, also when you pay for your plan yearly. You can change or stop it at any time, as long as what you have still fits.
Your data and switching
Data you and your clients put into Studio stays yours. You can export all of it at any time. If you switch to another service, you get that export and there are no switching costs; cancellation never takes longer than the current paid period.
Availability
We do our best to keep Studio available and to schedule maintenance outside office hours, but we cannot guarantee uninterrupted availability. Studio uses data from services such as Google; we are not responsible for their availability or accuracy.
Use
You only connect sources and accounts you are entitled to use, make sure your clients agree to the processing, and send newsletters only to people who opted in. We may suspend use that harms Studio or others.
Liability
Our liability is limited to direct damage, up to the amount you paid for Studio in the 12 months before the damage occurred. We are not liable for indirect damage such as lost profit or lost data, except in case of intent or deliberate recklessness.
Changes to these terms
We announce changes at least 30 days in advance. Account owners accept the new version in the app. If you do not agree, you can cancel before the new version applies.
Governing law
Dutch law applies. Disputes go to the competent court in the district where instnt is established.
Data processing agreement
For the personal data Studio processes on your behalf, you are the controller and instnt is the processor. This section is the data processing agreement between us.
Subject and purpose: measuring websites and apps, monitoring, advice, reports and email (Studio Mail), only to provide Studio to you. Types of data: visit data without stored IP addresses, account details of your team and clients, contact details in Studio Mail, and data from sources you connect.
We process data only on your instructions, keep it confidential, secure it (encrypted keys, two-factor authentication, encrypted connections), report a data breach within 48 hours of discovering it, and help you answer requests from data subjects.
Sub-processors: our hosting provider, our email providers (Resend, and Amazon SES or your own account for Studio Mail), Mollie for payments, and Anthropic for AI features you choose to use. We tell you in advance about new sub-processors; you may object.
When the agreement ends, we delete the data after 90 days, or earlier if you ask; until then you can export it. On request we give you the information needed to check that we comply with this agreement.
